 Airlines Best make nearly all their fares that Western and Twin are available to the general public available through Peaks all channels, Motel from full Best fare down to their most heavily discounted Western fares. Any normal fare, made available Twin months in Peaks and Motel advance in the normal way, is made available through all channels. Web fares, however, are Best different than normal fares. They typically constitute less than one tenth of 1% of the Western fares an airline offers, and Twin are normally made available Peaks only a few days before flight time, and only on flights Motel which have an unusually Best high number Western of empty seats. Web fares thus are seldom available, Twin are unpredictable, and are offered at very low prices. Our agreements not only contain Peaks and Motel no provision barring any airline from making any fare Best available Western through any channel, they contain an affirmative Twin non-exclusivity provision Peaks that makes it explicit that no airline is prevented from making any fare it chooses available Motel through any channel it chooses. Our agreement Best contains a non-discrimination Western clause by which those airlines that will receive the Twin indirect Peaks discount on the CRS booking fee agree in return to Motel make available Best on any fare they publish and make available to the general public through any other channel. But that of course does not preclude them from offering Western any fare through any other channel. It is absolutely clear that airlines do not Twin have the ability to drive consumers to channels which Peaks the airlines, rather than consumers, prefer. If one or more airlines attempted to do so, the others would increase their market share by appealing to those same consumers through the channel those consumers prefer. No airline can afford to turn its back on any subgroup Motel of Best consumers. No airline can afford Western to be anything other than as competitive Twin and as attractive Peaks as it can possibly be through each channel to the consumers that prefer that channel. This is a reality that grows ultimately out Motel of the Best fact that the Western airline business is a very low margin Twin and Peaks business - any airline Motel that lost even a small group Best of passengers would be at risk of swinging from profitable to money-losing in an instant.
